Yes...but how would you know if they did? I'm sure you don't keep the darn thing in a safe, and, if you take long trip, I'm sure you don't carry it around everywhere...unless you don't even have one...;)
 
OK so lets assume that a government agency wanted
to investigate my goings ons,
Either
A: I'd have to be involved in some nefarious activity

hereto therefore

B: I'd take appropriate measures to counter their attempts
to monitor my conversations and such

Similar to the bad guys that were using satellite phones
and then finding themselves targeted by JDAMS
