Federalist No. 45 said:
The powers delegated by the proposed Constitution to the federal government, are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State.

The operations of the federal government will be most extensive and important in times of war and danger; those of the State governments, in times of peace and security. As the former periods will probably bear a small proportion to the latter, the State governments will here enjoy another advantage over the federal government. The more adequate, indeed, the federal powers may be rendered to the national defense, the less frequent will be those scenes of danger which might favor their ascendancy over the governments of the particular States.

Whether you agree or not is not the issue.

Where does a Federal Judge get the authority to intervene in a State Constitutional issue?

He/she doesn't.

Sorry dude, BUT HEY, minx might stop by allude to something silly then call you "a conservative". Bishy might have something too, you just never know.

good luck and again sorry.

only when that issue impacts rights that are guaranteed at the federal level by the constitution?

so what issue are you being clever with here?

ah shit Minks I missed those parts of the Constitution
that guarantee
the right for homo’s to get married
the right for the offspring of illegal aliens to get free
healthcare, education foodstamps and WIC
For that matter the right for anyone who cares to walk right
into the country to do so
the right of the feds to preclude a state from enforcing
the feds own laws regarding illegal immigrants
and best of all the new idea that the government owns your person.

The national healthcare bill basically makes you the property of the State

So I guess these stupid Right wingers should shut the fuck up
sit down and enjoy the ride into the socialist hell we are headed for.

Viva Le Revolution!

Interesting. The federal Constitution trumps the State Constitution? Especially considering what Madison said.

so what issue are you being clever with here?

Gee Wally, how many Consititional amendments have been overturned recently?

Today's opinion is the product of a Court, which is the product of a law-profession culture, that has largely signed on to the so-called homosexual agenda, by which I mean the agenda promoted by some homosexual activists directed at eliminating the moral opprobrium that has traditionally attached to homosexual conduct.
