DALLAS – Near the end of her short life, Shayla Stewart, a diagnosed manic-depressive and schizophrenic, assaulted police officers and was arrested for attacking a fellow customer at a Denton Wal-Mart where she had a prescription for anti-psychotic medication.

Given all those signs, her parents say, another Wal-Mart just seven miles away should have never sold her the shotgun she used to kill herself at age 24 in 2003.

Her mother, Lavern Bracy, is suing the world's biggest store chain for $25 million, saying clerks should have known about her daughter's illness or done more to find out.

perhaps there's a way to database this stuff so the backgroundcheckers could get a sort of "yes" or "no" answer without any other details.

Walmart did what it should've...but that system is whacked as it stands.

Nope federal law prohobitz any discloschzer of medical records of any type.

if'n Yur not the nurse attending a patient, you ain't even 'spoze to know thuh patients name.

Besides that, a Farm-E-cyst aint not qualified to assume a diagnosis by the medEkashuns anyhoo. It would be outta their scope of practi, ....then Walmart would REALLY be up the crick with-out an oar.
 
The very type of instant background checks that would have prevented this was defeated in lieu of the waiting period. Also, there is a massive stalling wall from the medical community to keep medical records private.

Better take aim at me then. It's a fact.

Violent crime rates per capita among the major mental illnesses are lower than among the population in general.

Take away the rare disorder of Antisocial Personality Disorder, and the numbers are even less.

Schizophrenia, depression, bipolar disorder, and the other prevalent mental illnesses have no correlation to violent behavior.






As to this crackpot and her family's claims, it's pure unadulterated bullshit. Let this lawsuit prevail and every single assault involving any weapon, from a gun to a bowling ball, will result in similar suits being filed. Guns do not kill people; people kill people. It would be the same ideaology as suing General Motors if your teenager plows a Pontiac into a phone pole. Ludicrous doesn't even start to cover it.

Many states have far more stringent laws about this than the feds...Texas being one of them. Had they used those records to stop the trasnaction a lawsuit would have followed. Damned if ya do & damned if ya don't.
