It seems that the Constitution is very specific in Article IV, section 4 which states:
Since the health care bill is Fascist in its form it could be argued that the bill, in its entirety, is unconstitutional. What would the SCotUS say about this were a case to be brought on these grounds?

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened), against domestic Violence.
