A ninth-grade student has accused officials at a Southern California high school of discrimination for suspending him for wearing lipstick and eye makeup.

James Herndon, 16, said the five-day suspension imposed Monday by administrators at San Bernardino's Pacific High School was unfair because females are allowed to wear cosmetics on campus.

"If I can't wear makeup," he said, "then the girls or the staff can't wear makeup."

Herndon says his black lipstick and red eye makeup express the Wiccan religious beliefs he shares with his mother, a priestess in the neo-pagan faith. The suspension violates his constitutional right to free expression, he contends.

Herndon, who is repeating his second year at the school, has worn makeup since he enrolled, according to his mother, Valerie Wallace.

and after all, he is such an attentive pupil.
 
If he starts wearing a trenchcoat i'd take my kid out before he shoots up the school.

Personally, I'd want that kid outta any school my kid might frequent regardless. He's obviously not there to learn anything. Mumsie fixed that but good.
 
So a kid can be gay in school, but they can't wear makeup? I love consistency. Gimme a choice between some nut wearing wicca junk and another guy who wants in my pants and I'll take Marty Kay every time.
 
I'd rather let him wear the make up too. He's not going to become anything in his life, just as the title of this thread, but for the time being, he's not harming anyone, so let the idiot be.
 
So, they can afford for him to wear makeup every day, and lawyers, but
won't send him to a private school, or get a tutor?

He's taking up a seat, and resources from someone who's worth teaching. Let his Fairy mother homeschool him.
