Court Opens Door To Searches Without Warrants

NEW ORLEANS -- It's a groundbreaking court decision that legal experts say will affect everyone: Police officers in Louisiana no longer need a search or arrest warrant to conduct a brief search of your home or business.

Leaders in law enforcement say it will provide safety to officers, but others argue it's a privilege that could be abused.

The decision was made by the New Orleans-based 5th Circuit Court of Appeals. Two dissenting judges called it the "road to Hell."

The ruiling stems from a lawsuit filed in Denham Springs in 2000.

New Orleans Police Department spokesman Capt. Marlon Defillo said the new power will go into effect immediately and won't be abused.

"We have to have a legitimate problem to be there in the first place, and if we don't, we can't conduct the search," Defillo said.

But former U.S. Attorney Julian Murray has big problems with the ruling.

"I think it goes way too far," Murray said, noting that the searches can be performed if an officer fears for his safety -- a subjective condition.

Defillo said he doesn't envision any problems in New Orleans, but if there are, they will be handled.

"There are checks and balances to make sure the criminal justce system works in an effective manor," Defillo said.

I just want the answers Gato. plus as I said in the other thread, doesnt she have a responsibility to tell the people regardless under oath or not? Also I was afraid of this since the Patriot Act and Homeland Security
 
Our rights are being slowly eroded, and all you can think to do is rake one person over the coals...
 
ok I think you found where you me Chcr and Squiggs(I am not sure where Gonz stands) agree in our rights being eroded
 
Being eroded? BEING??? Hell son this is what started the whole "Gonz is a right wing nutcase". My pointing out where our rights are daily pushed out the window of a very tall building yet I am/was/will be the nut.

There are some I can justify (the Patriot Act). I've read it & until there is evidence of wrongdoing, it's not a problem.

PS -Don't start on the Patriot Act in this thread please. If you want I'll gladly participate in a piss on the Patriot Act thread.
 
I dont know if you are referred to as a nut because of the idea of our rights being eroded or blaming the liberals to be honest. I put the Patriot Act only because it was the first thing that came to mind when it was mentioned about our rights though both sides and other laws limited our rights.

Quick note...Liberals and conservatives are 2 sides of the same coin. Both sides want to eliminate our rights, but in different ways. The liberals want to eliminate any sembalence of religion in our public lives, and the conservatives want the press muzzled. The liberals want our right to bear arms restricted to the point of uselessness, and the conservatives want to control the peoples right to assemble. Wake up, people. This is just the latest step in a slow, and incremental loss of our basic rights, all under the guise of PC and the Patriot Act.

A quick addendum...Squiggy seems to be the greatest supporter of the liberals here, and I would like his views on the whole erosion...not just gun control. ;)

I've been thinking all day about this thread & this post. Everybody wants the press muzzled (until it suits them) but for the life of me, I can not figure out what you mean by the above.

:confused: I have trouble just supporting myself...but if you say so...

I've been rather confused with the presentations you offer about this great erosion. I don't surrender rights easily. Most of my posts in this forum lean toward not liking the long term affects of this administration with regards to our rights...That said, most of your examples seem to be more about the crowding of rights...where one person's rights overlap someone else's rights in an abrasive way. I've not been able to get a clear view of what you, personally, are seeking from the debate.
 
Wow, this is pretty fucked up. I somehow missed this yesterday.

I used to think I was conservative. Then my president lied to me, and is trying to take away basic human rights, injecting God into whatever I do in my personal life. Now, I still won't call myself liberal, but I'm finding more and more to go middle of the road on alot of these issues. I can see why they made it where they did, but don't understand how judges in this case can justify doing what they did.

My prediction- the first noise complaint that turns into a multi kilo drug bust is going to seriously test this judgement. Hopefully it will overturn it, but in this day and age, who fucking knows.

I missed this post..

Obviously, Gato, Rice and the rest of the administration knew absolutly NOTHING about Iraq other than Dubya wants to attack...:lol:

I want her to be sworn if shes going to testify about 9/11. If she doesn't testify, I'll exercise my right to decide why for myself...:shrug: This administration doesn't get the benefit of the doubt from me. They've proved themselves unworthy of it.
