Hats off to this guy.

WINNIPEG, Manitoba - For a 73-year-old Canadian man, 20 months in a smoke-free jail looked just too long, so instead he took 24 months in a prison where he can smoke cigarettes.

Angelo Foti was sentenced to 20 months for shooting and wounding a man in his backyard who was trying to repossess a snowmobile sold to Foti’s son, the Winnipeg Free Press reported on Tuesday.

In court on Monday, Angelo Foti was agitated when he realized the sentence would mean he would be in a provincial jail, where smoking is banned, the newspaper said.

Foti’s lawyer pleaded for a 24-month sentence instead, which means the man will go to a federal prison, where smoking is allowed.

In accepting the longer term, Foti, a dedicated pack-a-day man, ignored the wishes of this family.

If I were that judge, I wouldn't have let him plead for the longer sentence. Isn't the point of jail to make things hell so that you don't repeat your crimes?

Not in the 21st century. In the 21st century...jail is merely a place to go to, where you get 3 square meals a day, an excersize court/gym, entertainment, retraining, money for easy tasks (laundry) etc...while you wait for release.

It's more like a place to keep people off the streets for a while...

What the hell happened to 6x6' cells and chain-gangs? I know that AZ has some...but I hear that some places/jails are positivly posh. Especially the white-collar crimes jails.

it is supposed to be. but like Bish said it is not anymore tho in a way it is. it takes them away from society and such.
 
Regardless of how nice the digs are, I still relish the freedom to go out to my car, drive where I want, come home when I want, see who I want, oh, and having sex with a woman is pretty nice too.

I know, there are some prisons that even allow conjugal visits, but I don't think they should. In my opinion, all prisons should be hard labor, whether you are in there for petty theft or 1st degree murder, only the length of sentence should change.

And if you refuse to work, you get the bare minimum food that will keep you alive. Nothing else.
 
The underlying beliefs behind that sarcasm are the reason why jail isn't effective anymore.

If it's not cruel and unusual, it isn't punishment. I don't know the real figures, but I'd say 80% of the people in American prisons today are repeat offenders. This tells me prison is not such a bad thing to them. We need to make it so they're horrified of going back.

Note that I am very much for public flogging as punishment for certain crimes (drunk driving, for instance).

I agree chic. There is actually a syndrome these days among some prisoners. They can't conceive or deal with a life outside the prison walls, where they have to do for themselves, and so they repeat offend in order to be incarcerated over and over again.

I know prison ain't fun, and most of us value our freedom highly, but it's all perspective. For those living on the shady side of life, freedom is pretty dark and limited anyway, because chances are you are already hiding from someone. How much worse than that are todays prisons, relative to the crimes people commit?
