How much does this suck?

On Sunday I was driving home and I took a left in front of a truck I knew I could make it in front of....I was wrong. She was speeding and even later admitted it. Anyway all I knew was horrendous bone jarring impact. I leaped from my totalled truck and the first thing I noticed was that I was soaked in blood. I was paniced.....Worried that the police would impound my truck and I'd lose all my possesions in it. They tried to but I fought them til they made the tow truck driver tow it to my home and bill AAA for it.. I fought going in the ambulance but they convinced me to go finally, and I got to get 10 stitches in my head and looked over for about 4 hours.

The police had not ticketed me and I had heard paramedics at the scene saying how the other driver had admitted she'd been speeding. So I assumed since they had ample opportunity both at the scene and at the hospital to ticket me that they had either determined it was her fault because she was speeding, or it was a no fault situation.

So the next day I go out to the Jefdferson County Sherrifs office and find out not only do I get the blame for the accident but I get a $538 ticket I have no way to pay as well.

The upshot of all this is that now I have no car, no way to afford my increased insurance, no way to afford the ticket unless they make me an easy payment arrangement. I am already on disability for multiple reasons, and basically life would totally suck if not for the fact I have a motorcycle and and endorsement to my license to ride it, and it does not require insurnace to ride it.. I am almost to the point of making a beg-a-thon webpage!

Well, even if the lady were speeding, you failed to yield. The lady gets a ticket for speeding, you get a failure to yield.

Just try to be more careful on your bike, so as not to end up like me.
 
Yeah, I am glad nobody was hurt and bottom line there is a lot to be greatful for. I am banged up pretty bad. I felt no pain at the scene, but I sure feel it after.

Assuming you are claiming on your insurance for the damage to your car is it not possible to claim for personal injury too? In the UK you can get up to £7500 for whiplash. Add some scalp lacerations to that and you'd be heading closer to $15000.

Got to be worth a try, it would pay the fine for you at least.

the major thing is no-one is hurt, pad the insurance to pay the fine and the increase, didn't you have that flatscreen in the back that was broken?

From what he posted, I think it's safe to assume he only had liability insurance (that's the least the law will allow), which would mean he couldn't file a claim to get his car replaced or get any injury money. He could file a claim with the other driver's insurance, but since he was determined to be at fault by the police, he would get nothing.

His only hope is that his insurance company would fight for him to at least get "comparitive liability," which means the insurance companies say there's a 50/50 blame. I was able to get that in the accident I had in April despite the cops saying I failed to yield, because she stated she started to stop but didn't think she could stop for the red light so she decided to speed through the intersection, meaning the insurance company could say she was driving too fast for cinditions (raining).

I don't want a damn thing from anyone. If I could the only thing I'd want is for her speeding to come out and, me to not get all the blame from what I believe is a clear case of dual fault.

So tell me Gonz, what the fuck is insurance for if it isn't for paying out in the event of an accident? I don't recall suggesting anyone lied, simply that it was worth looking into the possibilty that he had already paid premiums that would cover that exact circumstance.

How about you stop judging people on facts you've just made up.

GNL, this is exactly why insurance premiums are so high. Insurance is there to pay legitimate claims. It's the spurious claims and the uninsured that drive the cost through the roof. People using an accident to "get some back" from the insurance company are costing you and me a fortune.

Gonz, For 10 years I worked in healthcare, primarily A&E (ER). It is generally the case that a blow to the head significant enough to cause a laceration also puts stress on the muscles in the neck. Paramedics in the UK are trained to automatically treat head injuries in RTAs as if they have a significant neck injury. I remember looking after a man who had been driving home when his van was hit from the side. He was instantly paralysed from the neck down.

It is also generally the case that a side or rear impact RTA hugely increases the chance of a whiplash injury.

I made an assumption based on many years experiance and years of University education. You made one based on predjudice and ignorance.

Where did I suggest that anyone "make up" an injury to claim for?

I didn't. I simply stated some facts. If the policy coveres personal injury and such an injury occurs then it is perfectly acceptable to claim for it. I suggested this because it was possible that Mark was unaware whether his policy covered this and to check it out.
