The Omnibus Transportation Employee Testing Act of 1991 requires drug and alcohol testing of safety-sensitive transportation employees in aviation, trucking, railroads, mass transit, pipelines and other transportation industries. DOT publishes rules on who must conduct drug and alcohol tests, how to conduct those tests and what procedures to use when testing. These regulations cover all transportation employers, safety-sensitive transportation employees and service agents -roughly 12.1 million people. Encompassed in 49 Code of Federal Regulations (CFR) Part 40, the Office of Drug & Alcohol Policy & Compliance (ODAPC) publishes, implements and provides authoritative interpretations of these rules.

Its like most things in the history of this country. When they first initiated drug testing for employees, they did go overboard, and all kinds of people screamed about right of privacy violations. Now that its old news its mostly only used in jobs that involve some safety aspect. A few employers still use it in some cases as is their right, being private entities. If you don't like it, work somewhere else!

Random's right- An employer has a right to test, and potential employees have a right to look elsewhere for a job. I wouldn't want to be working next to say, a backhoe operator who was stoned or wired or drunk, but what he does after work is his own damn biz. It's a shame, though, that coke is out of your system in a day or two, whereas THC lingers for a month. I know of one small company that pulled a surprise test on all it's employees. Cost quite a chunk of change just for the lab urinalysis, then they fired 90 per cent of the workers (pot use, mostly, and not on-the-job use, either) and couldn't get replacements. The fired workers pooled for a lawyer and took the co. to court. The company won the case, but it cost 'em another big wad in lawyer fees. They went bankrupt. Well, that's crap. But I really haven't heard of anyone getting tested. Even the people I know that work at chemical plants only have the threat of drug testing if they do something to cause suspicion.

Valedictorian from my high school was a Tram-Law pharmacist, until he got shit-canned for THC in his system. Can't have a weekend pothead handing out Vicadin and Perkydoodles, God forbid!

Does what minkey said count if I had my commercial drivers license before some beauracrat invented piss tests for drivers?
 
Everyone who is hired at Wal-Mart in any capacity has to take a urine test before they can work there. As far as I know, there are no follow-up tests which are given. Perhaps if you have an accident but I haven't seen anything on that since I have worked there.
