Martin Luther King Jr. fought for the enforcement of existing rights as guaranteed under the constitution, and as a last resort. Remember...there were several court cases before MLK started out. Rosa Parks, OTOH, broke no laws. Only the policy of the segregated south. For those who do not know, Rosa Parks also had issues before that time with the driver of that same bus. They fought unjust laws, to be sure, but not until they exhausted other routes to get things changed. Until you find me something on the legal challenges to gay marriage bans, they are nothing more than common criminals.

SEC. 31. (a) The State shall not discriminate against, or grant
preferential treatment to, any individual or group on the basis of
race, sex, color, ethnicity, or national origin in the operation of
public employment, public education, or public contracting.
(b) This section shall apply only to action taken after the
section's effective date.

The State (Mr Mayor in this case) granted preferential treatment by not arresting or otherwise stopping those responsible for the disbursement of State of California Marriage Licenses.

Read this...and this... before you start "Jim Crow". Federal law supercedes state law, and, since black voters were denied their voting rights during that period, such laws were against the constitution.
