Some should, some shouldn't. At least they weren't shot out-of-hand, which is legal under the Geneva Convention for people captured in a war zone with no uniforms (shot as a spy ring a bell?).

What I'm saying is that

1. Gitmo is not a gulag.
2. Gitmo is a hell of a lot better than being shot out-of-hand for being a spy.

and 3. Whether those held at Gitmo are guilty, or not, remains to be seen. Especially since Al Qaeda operatives were told to lie, and swore to do so, if captured and interrogated. After all...it's not a crime to lie to an 'infidel'.

Amnesty Int'l, the nonpartisan organization disagrees. Unlike the real bad guys who they used to keep an eye on, instead of joining those who make up stories while overlooking real tragedy.
