Woman on trial for felony child abuse using water hose

I sounds like the kid threw up or crapped her pants and the mom hosed her off before dressing her in dry clothes.

The story clearly states that upon inspection the authorities found no injuries -- not even the "rugburn" -- and her skin should have been removed according "stories [I've] heard" by the car wash manager.

This is a ridiculous prosecution. A FELONY? This country is in big trouble. Why is it that these overzealous, overreaching prosecutions seem to be so pervasive in Florida?

Trial Begins in Child Abuse Case Involving Car Wash Pressure Washer
Monday, July 14, 2008

A mother who was caught on tape spraying her young daughter with a car wash's pressure washer was in court Monday in a shocking child abuse case, MyFOXOrlando.com reported.

Niurka Ramirez, 22, turned herself in to police in March after security footage of the incident was released. She was charged with felony child abuse.

The girl was examined by a public health nurse at the time of Ramirez's arrest and was found to have no visible injuries. She is under the care of relatives and said to be in good condition since the incident, MyFOXOrlando.com reported.

Surveillance tape shows the woman getting out of a white Hyundai Elantra and putting money into a pressure washer. Another woman is seen bringing the girl out of the car. As the child tries to get away, one of the women sprays her with the high-pressure hose.

The woman sprayed water at the child's legs, chest and face. She then stripped the wet clothes off her, leaving her nude in the wash bay, authorities said. The child was dressed into dry clothes before the suspects fled.

"It stings, it burns,” car wash manager Marlene Diaz told MyFOXOrlando.com of the hose, which was on high power. “I've heard stories where this type of pressure, it forms like a rug burn and can actually take off the top layer of the skin."

Ramirez claims she is not guilty.

Not a good choice. A gas station bathroom sink would have been a better alternative. The woman should be charged with stupidity. I bet it stung the poor kid adding insult to injury....but a felony? I wish stupidity was a felony.

The Orlando story says:

ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) -- The mother of the child seen on a surveillance tape disciplining her young daughter with a high pressure sprayer faces her trial Monday morning.

...

Marlene Diaz, manager of Magical Carwash, called authorities after seeing what happened on surveillance video. When she heard the child crying, she ran out to help, but by that time both the suspects and child had left.

She must be one hell of a slow runner. -- j

My wife threw a couple of cups of water in my daughter's face when she threw her one and only tantrum. Talk about a shock. She didn't know what to do through all of the sputtering and coughing.

Its amazing that a person could be charged with the same crime as they would if they had beaten the child with a board.

It it's strong enough to peel skin, it shouldn't be in a car wash. Damn thing would take the paint off of the car. Pretty stupid of the Mum in question, tho'

You have to be careful with getting the nozzle too close to your car's finish as it will blow the paint off if there is a chip in the paint where the water can get under it and lift it off. Other than that, the finish is safe.

The video at the Orlando site says that the woman said she was punishing her daughter for throwing a tantrum in the car. She didn't jusyt leave her in the wet clothes -- which likely would have been a separate count in the indictment -- she dressed the kid in dry clothes.

One would think that if a person was out of control with rage at their child they would not take the time to redress the kid in dry clothes. This shows that she was not out of control or in any manner trying to harm the kid. All she wanted, apparently, was some cold water to throw on the kid to get her attention and get her under control.

I'm sure the kid will grow up to be an upstanding citizen with great respect for the authorities who took her mother from her.

By the way, there is no evidence that it can peel skin only anecdotal stories to that effect that the manager has heard.

There's anecdotal evidence of razor blades in Hallowe'en apples and pins in candy...

Not defending the mother in question. They should do the same for her. Let the kid work the hose this time.

There's a big difference between water from a cup (or even a hose) and water from a pressure washer. The pressure washer is at hundreds of PSI (much more pressure than what comes out of a fire hydrant) and could result in some injuries, especially if aimed at the face, where the eyes are, and if water at that high of a pressure is forced down the nose.

There are plenty of other ways to abuse children that don't leave visible marks.

I don't see this as your typical "prosecuting a spanking" case.

She's an idiot whose been publically humiliated. Prosecution is now persecution if you don't follow the government mandates. Leave her alone & drop the stupid charges.

Everyone's getting in their exercise, I see. Rather than ask the intelligent questions, go ahead and jerk that knee, jump to conclusions, and make total fools of yourself.

I own a pressure washer. It has a set of nozzles. They vary from one to wash windows, to one that'll tear a shoe apart. I've also used public ones. Most every one I'd seen has high and low pressure settings. Low, because there's precious little point in rinsing your car at 400mph. Even the High setting was far, far weaker than my home model. Why? Because the owner of the car wash isn't going to risk letting himself in for the hassle of lawsuits. Even with dozens of 'At your own risk" signs, audio recorded warnings and flashing lights, the ambulance chasers would have him in court 300 day a year just for shits and giggles claiming damages.

So, until I hear about what pressure settings were used and available, that the child was actually physically harmed as confirmed by a medical exam, and what extenuating circumstances were involved, I'll stay up here on the fence enjoying my beer watching you fools getting your workouts.

Gullible twits.

Just to let you in on this...

However...just to be safe...only discipline your children at home, and you'll avoid most of the lunacy you have in FL.

I just think a high pressure hosing is not the way to punsh a fit
I am not calling for her head, I'm just calling her stupid.

I bet that dunking your kid's head in a ice-cold water causes 'no visible injuries'.
Hell, "Waterboarding" causes no visible injuries, nor sleep deprivation, verbal and psychological abuse, etc etc..

It's all a matter of limits and perspective, eh.

Considering that everything you've mentioned is training for Special Forces, and the Navy SEALs, that entire post makes no sense...;)

If you read my post, you'll see that there's often a low pressure option on those guns. It's entirely probably that she went in expecting that, even if she used the high pressure ... which it doesn't appear that she did. And again, it's merely an assumption on your part, and the media, that it was done to punish.

It's funny ... a few years back, I held my kid's head face up under a running faucet in front of dozens of people. No one objected in the slightest. If a pressure washer had been the only handy source of fresh water, I expect I'd have shot him in the face with that, or thrown him into the nearest puddle of water.

It's not about the water pressure. It's about fitting punishments for transgressions...not to mention freaking surveillance cameras for pete's sake. Stupid.

I agree. If you are punishing your kids by using a pressure hose, then a) it's stupid, and b) what kind of sick fuck are you? Doesn't matter how low-pressure it is, it's still playing fucking mind-games with your kids.
