It just might be spike. That's what you don't seem to want to understand. The local community has the right to establish local custom. Even the state is too big for such things. The state however, has the right to set rules for the state.

The federal government does not have the authority to do either of these things. Since they tax so many goods & the states have not fought such taxation, we've, in effect, handed carte blanche power to the federal gov't. Read the Constitution & the Bill of Rights. There are specific limitations on power...Obama was right on that score - we're built on a set of "negative liberties"...the Constitution tells the government what it may not do. That doesn't mean that it may do anything not specifically denied...as in forcing Americans to spend their hard earned property on medical inmsurance or face jail.

The people are supposed to have the ultimate authority. Then city, county, state, federal, in that order have, limited & lessening authority. Telling a state that it must pass seal belt laws or the federal gov't will withhold gas tax revenue is nothing short of extortion.
